These Terms and Conditions (“Terms") govern your access to and use of https://analytaka.com (the “Website”) and the services provided by Ankit Himatsingka (“Researcher”, “Entity", “I”, “We", “Our" or "Us" as applicable). This includes any content, updates, and new releases. Ankit Himatsingka is a registered Research Analyst with registration number INH000018911, under SEBI (Research Analyst) Regulations, 2014.

1. Definitions

The following terms will have the meanings assigned here for the purposes of these Terms:

• 1.1 “Business Days”: Any day banks operate in New Delhi, India.

• 1.2 “Service(s)”: Refers to the Researcher's research services, including content, data, model portfolios of Indian listed securities, and research reports for which users pay a subscription fee.

• 1.3 “User”: Any person who accesses or uses the paid Services after agreeing to these Terms, including anyone authorized to access the Services on behalf of the registered user.

2. Eligibility

The Services are available only to individuals eligible to enter legally binding contracts under the Indian Contract Act, 1872. Persons who are “incompetent to contract” under the Act, including minors, are not permitted to use the Services. Users must be at least 18 years old and confirm that the information provided during registration is true, accurate, and complete.

3. Registration

Users must register to access Services. By registering, Users agree to provide accurate, current, and complete information. Failure to do so may result in termination of access. Fees for paid Services are determined based on the selected plan and may change; notice of changes will be posted on the Website or sent to the registered email.

4. Access

The Researcher strives to maintain uninterrupted and error-free access to the Services. However, access may occasionally be suspended for repairs, maintenance, or upgrades. The Researcher is not liable for any service disruptions during these times.

5. Provision of Services

The Researcher offers services related to Indian and international securities markets but does not provide profit-sharing services or guarantees on investment returns. Users should consider their own risk tolerance before making investment decisions based on the Services, as the Researcher does not handle trade executions or provide specific investment recommendations.

6. Investment Disclosures

The Researcher’s Services are not investment recommendations. Nothing on this website is shown as advertisement or promotion to influence user's investment decision. Users make their own investment decisions based on their risk tolerance, with the Researcher’s information used as one of multiple inputs. All performance information, including charts or backtested results, is for illustration only and does not guarantee future returns.  

7. Security

The Researcher is not liable for unauthorized or improper use of Users' accounts. Users are responsible for any unauthorized access or fraudulent use of their accounts and must indemnify the Researcher against any related damages or liabilities.

8. Use of Services at Own Risk

The Researcher reserves the right to refuse Service to anyone at any time. Users agree not to copy, reproduce, sell, or exploit any part of the Services or Website content without express written permission from the Researcher.

9. Trademarks

Researcher logos, service names, and related trademarks are the property of Ankit Himatsingka. Users may not display or use Researcher trademarks without prior permission.

10. Disclaimer of Warranties

Services are provided "as-is" without any warranty of any kind. The Researcher disclaims all warranties, including fitness for a particular purpose, and is not responsible for interruptions, errors, or risks arising from the use of the Services.
 

11. Arbitration

Disputes related to the Terms will be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in New Delhi, India.
 

12. Suspension and Termination

The Researcher reserves the right to suspend or terminate a User’s access to the Services if they violate these Terms or if a third-party reports any violations. Accounts may be indefinitely suspended if the User engages in illegal, fraudulent, or inaccurate activities.

User agrees to provide PAN, Adhaar, contact details & other such information as may be necessary for KYC. Subscription may be cancelled without refund on KYC failure.

13. Indemnity

Users agree to indemnify the Researcher against any losses or liabilities arising from their use of the Services, including legal costs related to third-party claims.

14. Disclosure

The Researcher may access and disclose a User’s information to comply with legal requirements or to protect the rights, property, or safety of the Researcher and other users.

15. Disclaimer

The Research Analyst (RA) is engaged in equity research and model portfolio services. The RA has never been suspended or barred from conducting business by any stock exchange, SEBI, or other authorities, nor has its SEBI registration ever been revoked. Furthermore, the RA does not participate in merchant banking, investment banking, or brokerage services.

Reports and research materials prepared by the RA should not be interpreted as an offer to buy or sell, or a solicitation to buy or sell any securities in jurisdictions where such activities are prohibited. These materials do not constitute personalized recommendations and do not consider the specific investment objectives, financial situations, risk profiles, or needs of individual clients. The data and content provided in the RA's materials and website, including but not limited to index values, return figures, and analysis rationale, are intended solely for informational and illustrative purposes.

Charts and performance figures may include back-tested or simulated results generated through standard methodologies. These do not account for transaction fees and other associated costs. They may also have potential or material conflicts of interest, which will be disclosed and managed per applicable regulations.

The RA does not guarantee favorable views or outcomes for any industry, sector, or business group. Investors are advised to consider all risk factors, including their financial condition and risk-return suitability, and seek professional advice before investing.
